Introduction
LOC stands for Look Out Circular. It is a mechanism used by Indian law-enforcement authorities to prevent a person wanted in connection with a criminal case from leaving the country or to facilitate the person’s identification and questioning at immigration checkpoints. An LOC is generally issued when the competent authority considers it necessary to prevent a person from evading the process of law.
Meaning of Look Out Circular (LOC)
A Look Out Circular is an alert circulated to immigration authorities regarding a particular person. When the person arrives at or attempts to leave an airport or another immigration checkpoint, the alert may be detected in the immigration system.
An LOC does not itself establish that a person is guilty of an offence. It is an investigative or enforcement measure used in appropriate circumstances. The action taken against a person depends on the specific instructions contained in the LOC and the applicable law.
Provisions To Issue LOC
There is no specific provision under any legislation (either CrPC or BNSS) in India that regulates the issuance of an LOC. However, a look out circular is issued under the guidelines issued by the Ministry of Homes Affairs (MHA). These guidelines are not penal in nature, and are rather administrative and executive in nature.
However, the statutory authority to restrict someone’s passport flows from the Passport Act, 1967.

When Is an LOC Issued?
1. To prevent a person from leaving India: Where an investigating agency has reason to believe that a person involved in a case may leave the country and avoid investigation or legal proceedings, an LOC may be requested.
2. When a person is deliberately evading investigation: If a person repeatedly avoids appearing before an investigating agency despite lawful requirements, an LOC may be considered in accordance with the applicable guidelines.
3. In serious criminal investigations: LOCs may be used in appropriate cases involving serious offences where the investigating authority considers the person’s presence necessary for the investigation.
4. To secure a person’s presence before the law: An LOC can assist authorities in locating a person who is required in connection with an investigation, court proceedings, or other lawful process.
5. At immigration checkpoints: When a person against whom an LOC exists is detected at an immigration checkpoint, immigration authorities may take the action specified in the circular, which can include preventing departure, informing the concerned agency, or allowing the person to proceed subject to the instructions.

Who Can Issue or Request an LOC?
LOCs are generally issued through the immigration authorities on the request of competent government or law-enforcement authorities, subject to the applicable rules and guidelines. The requesting authority must have a lawful basis for seeking the LOC and must comply with the prescribed procedure.
Conclusion
